Please read these Terms & Conditions and the related Policies carefully before using this website and attending classes.
ABOUT US
Musical Theatre Fitness Ltd (registered Companies House SC667153) welcome you to its website (‘Site’). Your use of this Site indicates your consent and unconditional agreement to be bound by these Terms of Use and by any policies or practices contained herein (including but not limited to our Privacy Policy and Code of Conduct). If you do not agree to be bound by these Terms of Use, you may not access or otherwise use any of the Site. Musical Theatre Fitness Ltd reserves the right to modify, alter or otherwise update these Terms of Use at any time, and visitors are encouraged to review these Terms of Use from time to time. Your continued use of a Site after the posting of any change to the Terms of Use will be deemed acceptance of the change.
The Site and all of the content and information they contain, or may in the future contain (including, but not limited to, text, photos, images, illustrations, graphics, designs, audio clips, videos, broadcast schedules, guides, promotional contests, press releases, articles, plans, reviews and information as well as trademarks, service marks, trade names, trade dress, copyrights, logos, domain names, code, patents and/or any other form of intellectual property) are owned or licensed by Musical Theatre Fitness Ltd or other third parties, and are protected by copyright and other intellectual property laws. Any names, titles, logos and designs displayed on the Site that contain Musical Theatre Fitness Ltd names, titles, logos, or brands are the exclusive property of Musical Theatre Fitness Ltd. Except for private and non-commercial use, you may not modify, publish, capture, perform, transmit, transfer, sell, license, reproduce, re-post, create derivative works from or based upon, reverse engineer, upload, link, distribute, exploit or alter any such content. If you print off, copy or download any part of the Site in breach of these Terms of Use, your right to use the Site will cease immediately and you must, at Musical Theatre Fitness Ltd option, return or destroy any copies of the materials you have.
UNAUTHORIZED USE, COPYING, REPRODUCTION, MODIFICATION, PUBLICATION, REPUBLICATION, UPLOADING, FRAMING, DOWNLOADING, POSTING, TRANSMITTING, DISTRIBUTING, DUPLICATING OR ANY OTHER MISUSE OF ANY OF THE MATERIAL IS STRICTLY PROHIBITED.

CHARGES
There is no charge to use the Site. However, your internet services provider may impose charges for you to have access to the amount of bandwidth required to use the Site. In addition, when accessing the Site from a mobile device there may be additional network charges according to your contract.
A. Live Streamed Classes
By purchasing a live streamed class, you are entitled to a zoom link to the specified scheduled class.

Purchasing one of our Rolling Pricing Plans entitles you to book onto any of the classes included in your specific plan (please see website for details). All Pricing Plans are a contract which automatically renews one month after the date of sale and will continue until you provide us with a written request to cancel.
B. On Demand Classes

By purchasing an On Demand Class, you are entitled to receive a private link to a pre-recorded class which will be valid for 24 hours from the date is was purchased. The link is intended only for the paying customer and must not be shared or streamed elsewhere.
C. Personal Training

Private personal training is arranged on a 1-1 basis for as many times in a month as stated on the contract. Contracts will commence on the sale date and will be automatically renewed each month until the client wishes to cancel their month contract.
D. Your membership

You must be over the age of 16 to book on to the Classes, unless otherwise agreed.

You must complete a PAR-Q questionnaire before you book on to any of the sessions that Musical Theatre Fitness Ltd offers. By completing a PAR-Questionnaire you confirm to us that you have no known condition or are undergoing any treatment that would prevent you from being capable of physical exercise in all material aspects.

On entry into this Membership Agreement and every time you undergo a class during your membership, you confirm to Musical Theatre Fitness Ltd that you have no medical conditions known to you that would mean that you are not capable of all forms of exercise and that such exercise will not be detrimental to your health. If in doubt, it is your sole responsibility to consult a medical professional or to cancel your membership.

Your membership applies to you personally. You may not transfer, assign or lend it to another person.

We reserve the right to implement a waiting list if we feel it necessary to do so.
D. Payments and Fees

Paying monthly for a Rolling Pricing Plan by card or PayPal via the online booking system – Payments for a monthly rolling Pricing Plan are paid 7 days after the free trial. Payment is due immediately after the free trila period. They remain active until cancelled. To cancel a monthly contract please email us at musicaltheatrefitness@gmail.com

All fees and charges are subject to periodic increases and we reserve the right to change the costs of our services at any point. 28 days’ notice will be given if this occurs.
E. Refunds

This is at the discretion of Musical Theatre Fitness Ltd.
F. Cancellation Policy

PT sessions and online live classes booked must be cancelled no less than 3 hours before the classes advised start time.

Sessions cancelled with over 3 hours’ notice can be rescheduled elsewhere within the agreed contracted period.

If a class is cancelled with less than 3 hours’ notice the session will be charged to the client.

Rolling monthly plans require one calendar months notice in writing to musicaltheatrefitness@gmail.com
G. Cancellation by us

We may cancel any contract or class pass without notice if you commit a material breach of this agreement including, but not limited to, a breach of Musical Theatre Fitness Ltd’s Code of Conduct.

We may cancel any contract or subscription without notice if any fees or charges remain unpaid 7 days after the due date.

We reserve the right to cancel any class or Personal Training session if an instructor is unable to attend a session due to unavoidable circumstances. In this instance we would re-fund any single payments.
H. Freezing a membership

Rolling Pricing Plans may be frozen in the event of serious temporary illness, injury or medical condition upon appropriate proof from a doctor or other suitably qualified medical professional.
I. Data Collection

In the course of your membership Musical Theatre Fitness Ltd may collect certain personal information from you including personal details, financial details and details about your health. We will use this information for purposes including managing your membership and contacting you. You will always be given the opportunity to opt out of such communications by getting in touch with us. You have the duty of keeping your personal information up to date and to inform us if you have any significant changes.

We will limit the access to the processing of personal information to our employees and management who may require its use for marketing or other services.

We reserve the right to use photos and recordings of classes (which may include you, unless you wish to opt out which you can do at times when photos are being taken) for press and other promotional uses.

We reserve the right to use videos sent in directly to Musical Theatre Fitness (which may include you) for press and other promotional uses.
J. Health commitment statement

We will take all reasonable steps to make sure all our staff are qualified to the fitness industry standards set out by EMD UK (The National Governing Body of Group Exercise)

We will respect your own personal decisions. You do not have any obligation to follow what our instructors advise you to do. We will however ask you not to exercise beyond your own abilities.
Your commitment to us

You should always exercise in a safe manor. You should exercise to your own abilities. If you are concerned or know that you may have a medical condition that may affect your training before you use our facility you should seek medical advice prior to starting an exercise programme or session.

If you have a disability you must follow any reasonable instruction to allow you to train in a safe environment.

There are risks when exercising. You should not undertake any exercises that you have been told are not suitable for you.
